finally got a response, phoned BT and it turns out there is a fault on the battery, if the battery has a part number ending 11M you have one of the problem one's. BT are going to courier me a new phone to replace this faultly one why they just couldn't send me a new battery but hey i'm getting a new phone to replace my 2 month old one. doesn't really fill me with confidence for using HTC tho.

Hi All again.
I have been in contact with BT again. They sent me a customer fault feedback Email. I assumed that te problem might be cleared so rang them. BT are sending me a new Battery, as HTC have issued them with some. HTC recon the new battery is OK. My man at BT (second line support) tells me they have only just finished testing the new Battery and he recons it has cleared this problem and some others that were bugging them. There is one in the post to me will let you know of progress.

So far so good new Battery and phone working OK no problems touch wood
